-Over Alleged US$140,000.00 Theft Of Property

Son of Former Vice President of Liberia, Ambassador Joseph N. Boakai, risks being jailed for an action of alleged theft of property in the tone of US$140,000.00 owed the star oil company.
It can be recalled that Joseph Boakai Jr. through his legal counsel pleaded with the judge of the Monrovia City Court for a pre-trial conference and such was granted by the Magistrate Kennedy Peabody of the City Court on Tuesday, July 10, 2018.
Joseph N. Boakai Jr. was summoned on Tuesday, July 10, 2018 by the Monrovia City Court based upon complained filed against him by the Republic of Liberia by and thru Star Oil Company over an alleged US$140,000.00 theft of property case.
During the conference, complainant counsel requested the defendant to file a criminal appearance bond and that the vehicle be impounded at the court same day at 4PM local time.
According to Cllr, Arthur Johnson, defendant shall provide before the court the vehicle in question and should as well impound said vehicle pending court trial and consequently serve court order on said matter.
Cllr. Johnson additionally said the defendant must file a valid application for criminal appearance bond by status of section 13.5 of the criminal procedure law of Liberia.
Furthermore, defendant counsel prays for pre-trial conference as mean of narrowing down the matter relating to the vehicle theft.
Defendant counsel expressed his client willingness to restitute in order to narrow down on the issue based on the crime and vowed to produce the Toyota Tundra.
They further disclosed during the pre-trial conference that defendant Boakai made a payment of US$10, 000.00 dollar through an unidentified angent of the company without any written document to prove such claims.
Meanwhile Magistrate Kennedy Peabody of the Monrovia City Court predicated upon a complaint filed by the Republic of Liberia by & Thru Star Oil Company Its Authorized officer against the defendant Joseph Boakai Jr.
The Writ indicated that, “You are hereby commanded to summon the living body of Joseph Boakai Jr. Defendant and cause him to appear before the Stipendiary Magistrate or any other Magistrate of the Monrovia City Court at the Temple of Justice in Monrovia, Liberia on July 10,2018 at the hour of 9:00AM to answer to the complaint of the Republic of Liberia by & Thru Star Oil Company and its Authorized officer, plaintiff the ministerial officer ,plaintiff in which it is substantially alleged as follow to wit” .
In the Writ of Summons, it indicated, “That during the period of 2017, in the city of Monrovia, Montserrado County, Republic of Liberia, thee within named defendant being there and then received private prosecutor company’s vehicle being one 2015 Toyota Tundra vehicle value US$140,000 for a rental basis”.
The writ further pointed out that said vehicle the defendant out of deception has concealed, thus exercising unauthorized control over same with the intent to deprive the private prosecutor thereof. Hence defendant is hereby ordered to appear in court on Tuesday July 10, 2018 at the precise hour of 9:00am to answer to the charge levied against him by & thru the republic of Liberia thru the Star Oil Company.
Under our law, Section 15.51 of the New Penal code of Liberia, the alleged act of the defendant is unlawful, wicked illegal, criminal, and intentional.
