Tropical Logistics Threatens To Go To ECOWAS Court

-As Justice Yuoh Lifts Ban On GVL

Tropical Logistics Inc. in Liberia has threatened to take Golden Veroleum Liberia (GVL) to the Economic Community of West African States (ECOWAS) in Nigeria Abuja for leaving the country while the case is pending before the Supreme Court.

With this latest report, Tropical Logistics Liberia, Inc had threatened to take the matter to the ECOWAS Court if the Financial Director and Controller  with some officials of the company fail to show up this coming Wednesday, March 27, 2019 for hearing into the matter.

This come barely two months after the then Justice In-Chamber, Sie-A-Nyene G. Youh lifted Judge’s Chan-Chan Paegar writ of Ne-Exeat Republica issued on the company (Golden Veroleum Liberia ) five months ago preventing its Financial Director and Controller Budhi Dharmawira from leaving the country until the matter is looked into.

“You are hereby commanded to inform Golden Veroleum Incorporated (Respondent) judge to lift the writ of Ne-Exeat Republica to read to them the original and make a copy of the writ of certiorari with the respondent (GVL),” Justice Youh mandated.

The then, Associate Justice Yuoh allegedly lifted the writ of Ne-Exeat Republica that was issued by the Commercial Court Judge Chan-Chan Paegar in the absence of one of the disputing parties (Tropical Logistics Liberia).

It is also reported that after Justice Youh lifted the ban of GVL, Budhi Dharmawira, along with other authorities of the company fled the Country and cannot be located.

The company (Tropical Logistics Liberia) has expressed disappointment and frustration in the high court for such decision “we visited Justice Youh on eight occasions but she yet telling us to go come back to our outmost surprise, she lifted the ban.”

It can be recalled that on January 18, 2018 Tropical Logistics Liberia, INC through its General Manager, Francis Juwle dragged Golden Veroleum Liberia Incorporated to the Commercial Court over an action of debts in the tone of USD$643,005.54.

Following the sue, the Associate Judge of the Commercial Court, Chan-Chan Paegar placed a stay-order on officials of Golden Veroleum Liberia Incorporated from leaving the Country and further communicated same with various exist and entry points of the Country until the matter before that honorable Court can be disposed of.

Judge Paegar issued the writ of NE-EXEAT REPUBLICA as prayed for by lawyers defending the legal interest of Tropical Logistics Liberia, INC represented by its General Manager, Francis Juwle and all official acting under its authority (Petition).

Judge Paegar further commanded his clerk to serve copy of the Writ of Ne-Exeat Republica to the Air Port of Liberia, the Freeport of Monrovia, the Bureau of Immigration and Naturalization (BIN) and all entry and exit points within the Republic of Liberia prohibiting and restraining Budhi Dharmawira, Elvis G. Morris and Pratirs from travelling out of the bailiwick of the Republic of Liberia, pending determination of the Action of Debt out of which this Writ of Ne-Exeat Republica grows.”

The writ also indicated that if the Respondent (GVL) cannot give a Bail Bond duly approved by the court, they will be commits in a common jail in Montserrado County until her own accord is given a bail and security.

The complainant petition for the writ of Ne Exeat Republica with the court is to ensures respondent Golden Veroleum remain within the bailiwick of the court’s jurisdiction or territorial confine of the republic of Liberia to answer to the debt action in the amount of US$643,005.54 pending before the honorable court.

Tropical Logistics Liberia in its petition says Golden Veroleum Incorporated and its legal Attorneys are staying away from the hearings in the above referenced case without any foundational or relevant excuse before the court; suggesting that if the writ is not issued, the Respondent (GVL) along with those acting under its authority could abscond or escape the bailiwick of the court, thus operating at the detriment of the petitioner’s economic interest.

Petitioner most humbly requests Judge Paegar to take keen judicial notice of the unmeritorious excise filed by Golden Veroleum Liberia that form the basis for this petition, because the intent of the respondent is to frustrate the petitioner to the extent of him(petitioner) leaving the case without remedy.

The Supreme Court of Liberia is expected to this week, Wednesday March 27, 2019 entertain argument in a case that involves Golden Veroleum Liberia Incorporated and Tropical Logistics Liberia, INC.
