MONROVIA-NOVEMBER 3, 2025: The 8th Judicial Circuit Court of Nimba County has accepted a Motion filed by lawyers representing the interest of WBHOSC for Relief of Judgment in the case before it court.
The case involves the management of WBHOSC of Nimba County as 2nd defendant and the Interestate of the Prince Gbeangan of Nimba County through its Administratix Mrs. Joretha Kehzie Quoi of Nimba County as plaintiff and Aries Dahn of Gompa City as 1st defendant.
The 8th Judicial Circuit Court had set aside default Judgment earlier rendered against the 2nd defender, and ordered that the case be reopened and that WBHOSC or Movant in the case be permitted to file responsive pleading and defend the action on its merit and grant it (Movant) further relief as may be deemed just legal and necessary.
According to court record in the possession of this paper, the 16 Counts Motion grew out of final default Judgment of the court it rendered on October 23, 2025 against the movant (WBHOSC), relying on chapter 41 and subchapter 41.7 of the criminal procedure law of Liberia.
“Based on the facts presented by the Movant and the records before the court, Judge Pape Suah ruled that if the plaintiff had any issue with the said release issued by the plaintiff’s husband, Stephen Quoi, for additional settlement, plaintiff should have made a demand for additional settlement or a payment as a benefit from 2nd defender (WBHOSC),” according to the court document.
By the court granting a motion for relief from judgement, means, the earlier guilty verdict against WBHOSC has been challenge. Earlier the court found WBHOSC liable for wrongful death and fined US$2.1M.
A Relief from judgement is a legal remedy that allows a party in a legal battel to challenge a court’s final decision after it has been entered; typically when new evidence arises or when there has been a procedural error or injustice.
Additionally, to correct errors or injustices that occurred during the original trial or judgment process, ensuring fairness and due process.
